Federal Judge Dismisses Mortgage Fraud Charges Against New York Attorney General Letitia James

Brooklyn — In a new development, a federal judge threw out the charges against New York Attorney General Letitia James, which were brought against her by the U.S. Department of Justice (DOJ) in October.
The DOJ charged James with bank fraud and making a false statement to a bank in connection with a property she owns in Virginia. She pleaded not guilty to the charges.
James argued in court that the case should be dismissed because the federal prosecutor was not properly appointed
In an order, Judge Cameron McGowan Currie agreed and concluded that Lindsey Halligan (the acting federal prosecutor for the Eastern District of Virginia) had “no lawful authority to present the indictment” against the Attorney General.
“I conclude that the Attorney General’s attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid and that Ms. Halligan has been unlawfully serving in that role since September 22, 2025,” Judge Currie wrote.
President Trump has been unable to persuade the Senate to confirm several U.S. attorneys in blue-leaning states, such as Virginia, leading the president and Bondi to sidestep the upper chamber at times to install Trump’s appointees, such as Halligan.
“I am heartened by today’s victory and grateful for the prayers and support I have received from around the country,” AG James said in a statement. “I remain fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day.”
The DOJ did not post a statement concerning the dismissal.
